Augenix AI is an assumed name of Lampasas Marketing LLC, a Texas limited liability company, located in Lampasas, TX.

2. Services

Augenix AI provides AI vision and automation services including but not limited to computer vision solutions, data analysis, process automation, and AI-powered business solutions.

3. User Responsibilities

When using our services, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Use our services in compliance with all applicable laws and regulations
• Not engage in any activity that interferes with or disrupts our services
• Not attempt to access data not intended for you

4. Intellectual Property

All content included on our website, including text, graphics, logos, images, and software, is the property of Augenix AI or its content suppliers and protected by copyright and other intellectual property laws.

5. Payment Terms

Fees for our services will be specified in your service agreement. Payment is due as specified in the agreement. Late payments may be subject to interest charges.

6. Cancellation and Refunds

Cancellation policies will be outlined in your service agreement. Refund eligibility is determined on a case-by-case basis and subject to the terms of your agreement.

7. Limitation of Liability

Augenix AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services.

8. Indemnification

You agree to indemnify and hold harmless Augenix AI and its affiliates from any claims, damages, liabilities, and expenses arising from your use of our services or violation of these Terms.

We reserve the right to modify these Terms at any time. We will provide notice of any material changes through our website or by other means.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

12. Data Ownership

You retain all right, title, and interest in and to the data, content, contacts, and other information you submit, upload, or generate while using the Services ("Customer Data"). Augenix AI and Lampasas Marketing LLC do not own Customer Data. We will not sell, rent, lease, or trade Customer Data to any third party. You may export or delete your Customer Data at any time using the tools provided in the Services or by contacting us.

13. Intellectual Property and Custom Automations

Augenix AI and Lampasas Marketing LLC own the entire Augenix AI platform, including all software, code, features, designs, and any custom automations, workflows, scripts, or other development work we build for customers (including work performed under a separate services agreement). You receive a limited, non-exclusive, non-transferable license to use the platform and any such custom work solely in connection with the Services during the term of your subscription or agreement.

All Customer Data processed by the platform or any custom automations remains your property as set forth in the Data Ownership section.

14. Use of AI Models

We use third-party artificial intelligence models to provide certain features of the Services. All inference and processing of Customer Data by such models is performed on servers located in the United States. We do not transmit Customer Data to AI model inference endpoints located outside the United States for processing.

15. Data Security and Privacy

Customer Data is private. It is accessible only to authorized employees and contractors of Augenix AI who need access to provide, maintain, or support the Services. We implement reasonable administrative, technical, and physical safeguards consistent with industry standards to protect Customer Data against unauthorized access, alteration, disclosure, or destruction. The Services are hosted using infrastructure provided by Supabase (running on AWS) and Vercel.

16. Data Export, Deletion, and Retention

You may export or delete your Customer Data at any time using the tools in the Services or by contacting us at info@augenix.ai. Specific retention and deletion rules for certain integrations (such as Gmail) are described in our Privacy Policy.

17. Enterprise Customers and Separate Agreements

These Terms of Service apply to your access to and use of the Services. However, if you have entered into a separate written agreement with Augenix AI or Lampasas Marketing LLC (such as a Master Services Agreement, Enterprise Agreement, or Platform Access Addendum) that expressly governs your use of the Services, the terms of that separate agreement will control to the extent of any conflict with these Terms.

Customers using standard plans (including any Starter, Pro, or self-serve offerings) are governed by these Terms and our Privacy Policy unless and until a separate written agreement is executed.
